High penalties continue to be imposed on Japanese companies and their employees for violating antitrust rules around the world. As antitrust regulators become increasingly tough and cooperate more on matters of enforcement, foreign exposure for Japanese companies expands.

Our expert cartel practitioners from the US, EU, Brazil and Australia invite you to a morning seminar, to be held with PaRR (part of the Mergermarket Group), on how to deal with international cartel investigations.

The first Panel will provide a ‘need to know’ update on the latest trends in cartel enforcement in Japan, the US, EU, Brazil and Australia. Specifically, this Panel will discuss:

  • What methods are being used to detect and punish companies and individuals?
  • What kind of behaviour is being targeted?
  • Are foreign agencies singling out Japanese companies?
  • What can Japanese companies expect to see in 2015?

The second Panel will discuss how to manage the risk in Japan, the US, EU, Brazil and Australia. The topics of discussion will include:

  • When does an overseas regulator have the power to investigate a Japanese company?
  • How do you deal with an antitrust “dawn raid”?
  • Should you defend – or apply for immunity or leniency? Where? What are the implications?
  • Can you enter into a settlement?
  • Will third parties bring actions for damages? How do you minimize exposure?
