Regulatory implications of the new guidelines for determining whether software constitutes a medical device

The Ministry of Health, Labour and Welfare (MHLW) issued “Guidelines for determining whether software is a medical device” on March 31, 2021. These Guidelines supplant the MHLW’s “Basic policy for determining whether software is a medical device”, further clarifying and refining the treatment of software and providing important practical guidelines for business operators.
